Introduction

These general terms and conditions (“Terms and Conditions”) govern access to and use of the Services, including all content, functions and features offered on or via Genossenschaffen.ch (the “Website”). Services

Genossenschaffen.ch provides users with access to email notifications and information about Swiss cooperatives (“Services”). The services are offered on an “as is” basis and subject to availability. Genossenschaffen.ch may change, suspend, discontinue or restrict the services at any time.

Payment

Access to the services requires payment of subscription fees, as stated on the website. All fees are in Swiss francs. Genossenschaffen.ch will inform users of fee changes at least 30 days in advance by email and on the website. Genossenschaffen.ch can change its fees at any time. Users will be notified of fee changes via email and on the website. The subscription fee is billed monthly or annually, depending on the plan you choose. Payments are processed via our payment service provider Chargebee (billing and invoicing) together with Stripe as the payment processor. Refunds are not available for subscriptions that have not fully expired.

Termination policy

Users can cancel their subscription anytime via their account dashboard on the website. The termination is effective at the end of the current billing period. Genossenschaffen.ch does not provide refunds for incomplete subscription periods.

User behavior

You agree not to use the Services for illegal or unauthorized purposes. Prohibited activities include violating Swiss laws, transmitting malware, spamming, hacking, and illegally accessing or using the services. You may not reproduce, duplicate, copy, sell, resell, or exploit any part of the Services without express written permission from Genossenschaffen.ch. This includes using data mining, robots, or similar tools to collect and extract data. You may not transfer or share access to the Services with third parties. Genossenschaffen.ch reserves the right to cancel any account that is believed to forward emails or notifications from the services to unauthorized third parties. If you violate these terms, Genossenschaffen.ch may cancel your subscription.

Account cancellation

Genossenschaffen.ch reserves the right to suspend or cancel your account if you violate these terms. We may also cancel your subscription due to inactivity or other business reasons. After cancellation, we will delete your account and all associated data.

Changes to the service

Genossenschaffen.ch reserves the right to change or discontinue all or part of the services with a reasonable notice published on the website and sent to users via email. We will notify users of significant changes via email and via the website. Continued use of the Services following notification constitutes acceptance of all changes.

Limitation of liability

Genossenschaffen.ch is in no case liable for indirect, incidental, special or sequential damage arising from the use of the services. The total liability of Genossenschaffen.ch is limited to the amounts paid by a user in the past year. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.

Governing Law

These terms are governed by Swiss law, excluding its conflict-of-law provisions. The place of jurisdiction is Zurich, Switzerland, unless mandatory consumer-protection provisions require a different venue. Genossenschaffen.ch and users hereby consent to the personal jurisdiction and jurisdiction of these courts.

Data protection

Please review our privacy policy, which explains how we collect, use, and share information from our users. The Privacy Policy is incorporated into these Terms by reference.

Miscellaneous

If any provision of these terms is held invalid or unenforceable, it will be severed from the terms and the remaining provisions will remain in full force and effect. A failure to enforce any right or provision shall not be considered a waiver. Genossenschaffen.ch may assign its rights and obligations under these conditions. These conditions represent the entire agreement between Genossenschaffen.ch and every user.
